{"id":1993,"date":"2018-10-16T11:13:47","date_gmt":"2018-10-16T16:13:47","guid":{"rendered":"http:\/\/nflconcussionlitigation.com\/?p=1993"},"modified":"2018-10-16T11:21:57","modified_gmt":"2018-10-16T16:21:57","slug":"bankruptcy-court-finds-nfl-concussion-settlement-awards-exempt","status":"publish","type":"post","link":"http:\/\/nflconcussionlitigation.com\/?p=1993","title":{"rendered":"Bankruptcy Court Finds NFL Concussion Settlement Awards Exempt"},"content":{"rendered":"<p>In what may provide a protective shield for retired players, the U.S. Bankruptcy Court in the Southern District of Florida recently ruled that <a href=\"https:\/\/www.nflconcussionsettlement.com\/ViewPDFDoc.aspx\">Monetary Awards under the NFL Class Action Settlement Agreement<\/a> are exempt property.<\/p>\n<p>That means, if you file <a href=\"https:\/\/www.thebankruptcysite.org\/bankruptcy-exemptions\">Chapter 7 bankruptcy<\/a>, your Monetary Award may not be subject to creditors taking your award to pay off debts.<\/p>\n<p>The Court found that the Monetary Awards under the NFL Class Action Settlement Agreement fall within the exemption provision of <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/11\/522\">Section 522(d)(10)(c), which exempts \u201cdisability benefits.\u201d<\/a><\/p>\n<p>The Court said that the Monetary Award, unlike a typical tort claim settlement that is not exempt, is \u201cundeniably indicative of a disability policy.\u201d This is because, the Court reasoned, the \u201coverall structure of the Settlement Agreement and the medical procedures in place to filter claims.\u201d<\/p>\n<p>The Court noted the \u201cmultitude of procedural hoops\u201d a retired player must go through in order to obtain a Monetary Award. For example, a player must be diagnosed by a qualified physician with a specific diagnosis; the award is not guaranteed; and the amount of the award is dependent on age and years of service, among many other factors.<\/p>\n<p>This decision is quite surprising, yet well-reasoned. Whether other bankruptcy district courts will accept this reasoning is yet to be seen.
